Tour Terms and Conditions

All reservations are subject to the following conditions:

Deposits

To book a cycling tour a deposit of $1000 per person is required (Tour Down Under $500 deposit). A reservation will not be confirmed until this deposit has been received.

All deposits are non refundable within 6 months of tour starting. (Travel insurance MAY cover most cancellation fees and should be taken out at the time of booking a tour).

A reservation is not confirmed until the $1000 per person deposit has been received. Seats are not held until payment is received.

Final Payment – European Tours

The balance of your payment is due as follows.

  1. If you have paid your deposit before 31 December your balance is due on 1 March.
  2. For all other deposits made after 31 December your balance is due within 30 days of paying the deposit.

Final Payment – Tour Down Under

The balance of your payment is due as follows.

  1. If you have paid your deposit before 30 September your balance is due on 30 November.
  2. For all other deposits made after 30 September your balance is due within 30 days of paying the deposit.

Cancellation Policy

If for any reason you need to cancel your tour, the person or persons participating in the tour must confirm the cancellation in writing.

The following cancellation charges will apply: All deposits are non refundable up to six months before your tour starting.

If you cancel your tour more than 160 days before departure, we will refund 75% of your tour payment (excluding deposit).

If you cancel your tour between 90 and 160 days before departure, we will refund 50% of your tour payment (excluding deposit).

If you cancel your tour less than 90 days before departure, no refund will be given of either your tour payment or deposit.

We reserve the right to cancel any tour up to 30 days before the start of the tour, in which case you will have the choice of all payments made, including deposits, being refunded 100% or held in credit for another Kiwi Style Bike Tour.

We reserve the right to cancel any tour within 30 days before the start of the tour in circumstances that are beyond our control.  In this case a partial refund will be offered reflecting the deduction of any costs or loses that cannot be recovered from the tour preparations already undertaken.  The refund will be calculated in good faith in respect to direct costs to Kiwi Style Bike Tours and will not include any time or labour losses of Kiwi Style Bike Tours.

Tour Changes, Postponements, Cancellation and Modifications

We reserve the right to make any hotel changes, route changes or make any change, modification, cancellation, postponement or delay to a tour or part of a tour that we deem necessary, due to circumstances, information or conditions that are known to us and will inform all clients as soon as practicable.  This applies to changes being made before a tour starts or during an operating tour.  These will be made in good faith to protect the health, wellbeing and safety of participants and will be based on information available to us at the time, particularly in regards to adverse weather conditions. In the event of any change, modification, cancellation, postponement or delay under this condition, you acknowledge that you will have no right of refund of the tour price (whether in whole or in part) and no right to claim compensation for any injury, loss or damage or other additional expenses incurred by the changes, modification, cancellation postponement or delay.

Force Majeure

If we are prevented (directly or indirectly) from performing any tour obligations by reason of an act of God, strikes, trade disputes, fire, breakdowns, epidemics and pandemics, interruption of transport, government or political action, travel bans imposed by governments, acts of war or terrorism, acts or omissions of a third party or for any other cause whatsoever outside our reasonable control, Kiwi Style Bike Tours will be under no liability whatsoever to you and may cancel the tour wherein our cancellation policy will apply.

Travel Insurance

All participants are responsible for their own travel insurance, covering accident, personal injury, loss of luggage and cancellation. This should be purchased at the time you book your trip.

It is compulsory for all persons who join a tour with Kiwi Style Bike Tours to take out an appropriate travel insurance policy which must include a minimum of NZ$1,000,000 Public Liability Insurance.

Liability

We are not liable for personal injury, death, damage to property or other loss whether arising from accident, cancellation, delays or any other matter beyond our control.  Ensure your travel insurance covers all of these scenarios where available, including while on tour, as well and pre and post tour travel.

The attached waiver and release must be completed and signed before commencing the tour with Kiwi Style Bike Tours.

Participants

Participants are required to have had their bicycles serviced by a cycle shop in New Zealand before leaving for a tour and shall have a receipt of this being done.

The wearing of approved cycle helmets is compulsory at all times.

It is participant responsibility to be fit and healthy enough to complete the scheduled rides.  All participants must abide by any local government health rules, regulations and advise while on tour.

Any health problems and concerns must be reported to Kiwi Style Bike Tours before the start of the tour.

All tour bookings are made as a tour package of inclusions as outlined on each tour itinerary.  The tour inclusions cannot be exchanged, refused, rejected or unused for any form of credit or refund.  Any inclusions not taken or accepted by the participant will not be refunded, including any meals missed or refused for any reason.  The participant has no right to claim compensation for any injury, loss or damage or other additional expenses incurred by any inclusions that is missed, refused, unused or rejected by the participant.

We reserve the right to decline any applicant whom we believe is not suitable for a tour.

A minimum of 7 persons are required for a tour to start. If a tour is cancelled due to insufficient numbers we will offer a similar tour on a different date where available, or refund 100 percent of tour payment (including deposit).

KIWI STYLE BIKE TOURS WAIVER AND RELEASE.

  1. Acknowledge that cycling can be an inherently dangerous activity. I recognise that there are risks and hazards specifically associated with this activity, including the risk of serious injury and/or death and/or property damage.
  2. Agree to comply with all rules (including road rules as applicable), regulations, and all lawful instructions and directions of Kiwi Style Bike Tours, its directors, officers, employees, contractors, and volunteers (the Organiser(s)) during the Tour. If I fail to comply with the rules, regulations, and instructions and/or directions of the Organiser, I will not be permitted to continue to participate either fully or partially at the Organisers discretion.
  3. I understand and acknowledge the dangers associated with the consumption of alcohol, prescription medicine and/or any narcotic substance before or during any activity on the Tour. I accept full responsibility for injury, loss or damage arising from consumption of alcohol, prescription medicine and/or any narcotic substance.
  4. Acknowledge that if I suffer any injury or illness, I agree that the Organiser may provide evacuation, first aid and/or medical treatment at my expense and my acceptance of these terms and conditions constitutes my consent to such evacuation, first aid and/or medical treatment.
  5. Acknowledge that injuries received may be compounded or increased by negligent rescue attempts, operations or procedures of the releases and agree that this Waiver and Release extends to all acts of negligence by the Organiser, including negligent rescue operations and is intended to be as broad an inclusive as permitted by the laws of the Province or State in which the activities are conducted.
  6. Acknowledge that I have sole responsibility for my personal possessions and/or sporting equipment during the Tour. I acknowledge that if the Organiser performs any repairs or work on my bicycle or other equipment the Organiser does not warrant that work nor offer any guarantee of any kind in respect of that work.
  7. I hereby:
    1. Waive and release all claims I may have against the Organiser or any one or more of their executors, administrators, heirs, next-of-kin, successors and assigns including any or all claims for injury, loss or damages caused by negligence of any of the above arising out of my participation in the Event, together with any costs including legal fees that may be incurred as a result of such claim whether valid or not;
    2. Indemnify and hold harmless the releases and each of them against any such claim that I or any one or more of my executors, administrators, heirs, next-of-kin, successors and assigns may have or assert and against any costs including legal fees with respect thereof; and
    3. Acknowledge that if I were to assert a claim such claim would be subject to the exclusive jurisdiction of the laws of New Zealand.
    4. Hiring of rental bikes:
    5. If I have chosen to use the Bike Hire option, I am aware I am liable for any damage caused to any bicycle hired from Kiwi Style Bike Tours while I am using or in charge of the bicycle.

I will also make sure the bike is in a sound and safe condition before using the bicycle and also agree to make Kiwi Style Bike Tours aware of any mechanical fault on the bicycle so the said fault can be made safe or repaired before using the bicycle.
If any portion of this Waiver and Release is held invalid, it is agreed that the balance shall continue in full legal force and effect.

I acknowledge that I have read this Waiver and Release. I fully understand its terms and that I have given up substantial rights by agreeing to it. I accept this document freely and voluntarily without any inducement made to me and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
